There has been a rumor running across the internet stating Robert Dean Jr. and T.O.P.G.U.N. has been terminated by The Limu Company. Well I reached out to Gary Raser the founder of TLC, and he confirmed Robert Dean Jr. and T.O.P.G.U.N. had not been terminated, but Robert Dean Jr. and about 30 other T.O.P.G.U.N. members had been suspended as per the Limu P&Ps, as the investigation continues on the rumors that Robert Dean Jr. and T.O.P.G.U.N. has joined Momentis Energy, the marketing arm of Just Energy out of Canada.

Update Jan 25th 2012 7:13 pm – Rober Dean has contacted me and we will be talking next week so he can give me his side of this situation.

Ted, did not take the time to vet the info, but went directly to publishing the information.

Ty Tribble, took a little diffeent approach when we wrote “Robert Dean Terminated From Limu Company?”

Ty dug a little deeper to show that Robert Dean has a deep track record of jumping from company to company.

What is interesting is in August 2011, at the official launch of T.O.P.G.U.N. and Robert Dean Jr. at Limu here is what was written.

“Nothing could have prepared us for the wild ride that was the official Top Gun Launch in Atlanta this past weekend. Hosted by 100K powerhouse and industry expert Robert Dean, it was an honest-to-goodness thrill ride, from Friday night’s standing-room-only opportunity meeting (with over 50% as guests!) to a barrage of specially-designed 20K rings being handed out to highly informative training after training and more. LIMU President Gary Raser was on hand, too, as were Vice President of Business Development Ryan Barson and Vice President of Marketing, Kerry Brown, all sharing their collective vision of the company’s future, one that looks very vibrant, indeed. 500K Members Shannon and Rachette Pardue were there as well, sharing positive words of support. When I did a Google search on “Robert Dean Leaves” here is what I found:

Momentis Energy, the marketing arm of Just Energy is making a very risky move for such a young company, and could see what small amount of momentum they have enjoyed dwindle, especially if they are hit with regulator issues because this new team is too zealous in promoting the business and the opportunity.

What is also very interesting about this issue, is Robert Dean always uses the same excuses for leaving a former company “There is no money”. Well he just jumped into a sector where the residual income is very low, and the majority of the money earned is from building the network.

If he didn’t think $1 million dollars in 10 months at Limu was enough, then it makes me wonder where he will jump next?

The Direct Selling Association is very straightforward in the Code of Ethics what is best business practices, which may be why Momentis Energy is not a member:

Medifast reported net revenue increased 13 percent to $76.1 million from net revenue of $67.3 million in the third quarter of the prior year. Each of the company’s three primary distribution channels, Take Shape for Life, Direct Response Marketing and Medifast Weight Control Centers and Wholesale Physicians, contributed to this year-over-year revenue increase. Revenue in the direct sales channel, Take Shape for Life, increased 6 percent to $46.4 million in the third quarter of 2011 compared to $43.7 million in the same period last year. Growth in revenue for Take Shape for Life was driven by increased customer product sales as a result of an increase in the number of active health coaches. The company ended the quarter with approximately 10,300 active health coaches, an increase of 14 percent compared to 9,000 in the third quarter of 2010, and flat sequentially from the second quarter of 2011. Nature’s Sunshine Products reported third-quarter financial results for 2011. Net sales were $91.1 million, compared with $86.1 million in the same quarter a year ago, an increase of 5.8 percent. Earnings for the quarter included non-recurring contract termination costs of $14.7 million related to the NutriPlus arbitration settlement. Excluding the contract termination costs, pro forma operating income and net income from continuing operations increased by 148.8 percent and 153.9 percent, respectively, compared with the third quarter of 2010. Operating losses from continuing operations were $5.1 million, compared with operating income of $3.9 million in the same quarter a year ago, a decrease of 231.7 percent. Read On…

Primerica has formed a partnership with Lincoln Financial Distributors, the wholesale distribution subsidiary of Lincoln Financial Group, to enable approximately 82,000 of Primerica’s 92,000 licensed representatives to offer Lincoln’s Fixed Indexed Annuity product as part of the company’s suite of retirement planning solutions. Implementation of the alliance is scheduled to be complete early in 2012.

RBC Life announced its third-quarter 2011 results, reporting an increase in consolidated net sales of 15 percent. Net sales for the quarter ended Sept. 30, 2011, were $7.1 million compared to net sales of $6.1 million for the same quarter in 2010. For the third quarter of 2011, the company also reported a net loss of $290,000 compared to net earnings of $133,000 for the same quarter last year. Read On…

TriVita has been asked to modify or discontinue certain claims made in direct-response advertising for its cactus fruit juice-based dietary supplement, Nopalea, by the Electronic Retailing Self-Regulation Program, which monitors advertising and marketing in the direct-response industry. The group said while the science behind Nopalea was useful it was not enough to substantiate the claims of benefit for specific health conditions used to market the product. TriVita noted studies on the product are underway, adding it takes great care to truthfully and accurately advertise its products.

USANA is currently constructing, on the roof of its West Valley headquarters, the largest solar panel installation by a non-governmental organization in Utah. The company’s solar panels will generate 167 kilowatts of electricity at peak production and will eliminate more than 270 pounds of sulfur dioxide, 330 pounds of nitrogen oxide emissions and 190,000 pounds of carbon emissions annually, which would normally be generated from energy production on Utah’s electricity grid. Eliminating these pollutants is part of USANA’s commitment to promoting human health and the health of the environment.

What follow are my personal observations on the subject of commissions on sales aids. This article should not be construed as the rendering of legal advice. Companies and distributors needing specific counsel in this area should retain an attorney skilled in direct selling law.

The conventional wisdom followed by the vast majority of companies is to pay no commissions on sales aids. What follows is the reason “why”: Although no specific state or federal law prohibits paying commissions on sales aids, if the company gives independent contractor representatives an incentive to recruit more representatives, and that incentive is greater than the incentive to sell products and services to consumers, that is exactly what those representatives will do.

The few companies paying some form of commissions on sales aids, and who in my view are not at risk, have that portion of their business a VERY SMALL portion of their total business. I believe 15 percent or less is very small and defensible, as long as there are

no other regulatory issues. Also, the commissionable sales aids are always optional, and never a requirement of participation in the income opportunity. Read On…

Over the last few months I have seen an increase in free to low income opportunities launching within the network marketing arena, which from the outside sure seem to fall under the legal definition of illegal pyramid, vs. a legal direct selling compensation structure.

At the same time I have seen a huge increase of network marketing professionals starting to video their back office to prove their incomes or upload images of their actual checks in order to combat the hype of these questionable business opportunities.

This last week, I entered into a discussion on FaceBook, where some great boys, were questioned my understanding of the laws when it comes to income claims and disclosures.

There understanding is, if the figures they are showing are legit, then it is cool to show their income. WRONG!

Just showing income, without providing complete disclosure on what all distributors make on average (Income Disclosure Statement) is illegal in most states and at a federal level.

Income claims and disclosures is 100% in the hands of the company, not the distributors. And depending on the industry a network marketing channel is being used, showing income without the right disclosures could result in hundreds of thousands if not millions in fines.

So, what are the guidelines and how can you as a distributor or even a company executive protect the team and the longevity of your organization?

1. DO NOT allow any income claims (actual or projected) period! This is the most conservative way to protect your team.

2. Company provides a current Income Disclosure Statement on the main website for prospects, regulators and distributors to review for current income facts.

3. Create and enforce a company policy that all income claims, actual or projected are for “internal training only” and are only created by the company.

Now, let’s look at a few other issues, that most distributors never take into account when making income claims; actual or projected.

1. Lately it has become common business practice to pay signing bonuses, make bridge loans, or provide some form of performance bonus to top leaders. Under the current FTC Endorsement Guidelines, if a Master Distributor or top leader received any form of compensation outside of the normal compensation plan, this could open the door for a potential legal liability. If any form of income claim is made, and all parties involved do not disclose specifically how the income is earned, then the FTC may see this as an “unfair business practice.”

2. Under the majority of company P&Ps (Policies and Procedures) it is made clear, all company information is propitiatory and the distributors are placed under “NDA” (Non-Disclosure Agreement), so when a distributor shows their back office to validate their income, they could possibly be violating their distributor agreement, and end up being suspended or terminated.

I want to provide some additional resources for you to review. Remember, the goal is to do everything you can to correctly build your network marketing business.
