The Amacore Group Inc. Enters Mutual Compromise Settlement Agreement and General Release of Claims with AmeriPlan, Zurvita, TransMark Financial Services Inc. and Mark Jarvis

On July 9, 2009, The Amacore Group Inc. entered into a mutual compromise settlement agreement and general release of claims with AmeriPlan, Zurvita Inc., TransMark Financial Services Inc. and Mark Jarvis.

Pursuant to the settlement agreement and in consideration for the dismissal of all claims and counterclaims of the action, the company and Zurvita agreed to pay AmeriPlan the sum of $1,150,000.

In addition, Zurvita agreed to issue a promissory note to AmeriPlan in the principal amount of $600,000 bearing interest at a rate of 7.5% per annum, payable in 24 monthly installments of $26,999.76 beginning on July 1, 2009 and each month thereafter until paid in full, with the first payment being made on July 9, 2009.

In connection with the issuance of the note, the company entered into a guaranty agreement, pursuant to which the company guaranteed the payment of the note by Zurvita.

Troy’s Truth: This is truly the sign of Servant Leaders putting what is best for their Distributors ahead of a bitter and nasty MLM Legal Battle which in the end would hurt both companies and their field force.

My hat is off to Mark Jarvis and his corporate team who worked hard over the last few months to bring this to an end, so they could get on at building Zurvita.

This weekend the Zurvita family all converged in Nashville where Mark Jarvis and the corporate team at Zurvita unveiled one of the great strategic moves in the current MLM Wireless war.

After months of behind the scenes discussions, and some of the agreements coming down to the wire, Zurvita was able to create one of the most unique wireless business models available in Network marketing.

Here are a few of the unique benefits on the Zurvita Mobile program.

1. Current subscribers within a company can switch their current plans to a Zurvita plan. In other words I can take my AT&T plan, and have it converted to a Zurvita AT&T plan. This is HUGE!

I met Steve close to a decade ago, when he rose to become one of the top leaders in the MLM company I ran. It was during this time, I had the pleasure of seeing Steve and Julie’s love for each other, their family, their team and most of all their Lord.

It is truly amazing how just a few years ago we were facing the MLM Juice wars between Noni, XanGo, Vemma, Lima, Goji.

Then came the Energy Drink wars – Nope that one was won before it got started by Drink ACT who hit the ground running and gave away millions of free samples, and now lead the pack.

But, even after reaching over $500 million per year in less than three years, Ignite Energy is not even close at winning the MLM Energy war.

This is truly the new wave of companies and like Excel Communication, these new energy companies are going to dominate in the next few years IF… They can keep their distributors in line, and focus on long term growth, and not just short term quick cash.
